Sec. 42-800. Rezoning of 2106 Vichy Road, from R-1 (Single Family District) zoning to C-O (Office District) zoning, City of Rolla, Phelps County, Missouri (Parks).

  1. That the Basic Zoning Ordinance No. 3414, Chapter 42 of the Code of the City of Rolla, Missouri which zoning ordinances adopts zoning regulations, use districts, and a zoning map in accordance with the comprehensive plan is hereby amended by changing the zoning classification of certain property situated within the City of Rolla Missouri at 2106 Vichy Road from R-1 (Single Family District) zoning to C-O (Office District). That the Basic Zoning Ordinance No. 3414, Chapter 42 of the Code of the City of Rolla, Missouri, which zoning ordinances adopts zoning regulations, use districts, and a zoning map in accordance with the Comprehensive Plan is hereby amended by changing the zoning classification of the following property situated within the City of Rolla, Missouri, from the Neighborhood Business District (C-1) to the General Retail District (C-2) described as follows:

    The 0.51-acre tract of land that is located in the city of Rolla, Missouri, at 112 and 114 North Spilman Avenue and is described as Lot 1 and Lot 2 of Block 4 of Cowan's Addition.

Sec. 42-810. Rezoning Lot 1 and Lot 2 of the Rolla Skilled Nursing Facility Plat No. 1 Subdivision, which is also known as 2735 Eagleson Drive, from the Single-Family District (R-1) and the Two-Family District (R-2) to the Multi-Family District R-3B (R-3B) and to rezone Lot 29 and Lot 30 of the Arwood Hills No. 1 Subdivision from R-1 to R-2 and to amend the future land use map to designate Lot 1 and Lot 2 of the Rolla Skilled Nursing Facility Plat No. 1 as Residential Medium/High Density.   1. Sec. 42-811. Annexing the 42.06-acre parcel identified with the Phelps County Assessor’s Account Number of 12081 and the designation of said parcel as the Multi-Family District (R-3) on the Official Zoning Map of the City of Rolla. (St. Maria’s)

  1. That the full voluntary annexation procedure, as outlined in RSMo. 71.012, will require a public hearing and the City Council determination that the annexation proposal meets the criteria established under Missouri State Statute RSMo.71.0I2; and (Ord. 4420, §1)

  2. That the applicant(s) request(s) that the City Council of the City of Rolla, Missouri, annex into the corporate limits of Rolla, Missouri, the property that is presently unincorporated, yet contiguous to the corporate limits of the City of Rolla, Missouri, and that is identified with the Phelps County Assessor’s Account Number 12081 and is more particularly described as follows:

    A fractional part of Lot 1 commencing at the Northwest Corner of the West Half of  Lot 1 of the Northwest Quarter of Section 6, Township 37, Range 7 West, running; thence East along the quarter section line 100 rods; thence South 64 rods; thence West 100 rods to the township line between Township 37, Range 7 and Township 37, Range 8; thence North along the township line 64 rods to the place of beginning, all in Section 6, Township 37, Range 7 containing forty acres, more or less. Sec. 42-814. Rezoning a 0.99-acre portion of Tract A of the Joyner Estates Subdivision, which is also known as 1335 Thomas Drive, from the Rural Residential District (R-R) to the Single-Family District (R-1). (Moutray)

  1. That the Rolla Planning and Zoning Code, Ordinance No. 3414, which is Chapter 42 of the Code of the City of Rolla, Missouri, and a code that, in accordance with the Comprehensive Plan, divides the City of Rolla into zoning districts; controls the regulation and restriction of the erection, construction, reconstruction, alteration or use of buildings, structures, or land within such districts; and controls the number, shape, and area of  such zoning districts on the the Official Zoning Map, is hereby amended by amending the Official Zoning Map in a way that will change the designation of the following described property from the Rural Residential District (R-R) to the Single-Family District (R-1):

    A parcel of land being part of Tract A of Joyner Estates as recorded in Plat Cabinet "D", as Slide 331 and situated in The Southwest Quarter of the Northwest Quarter of Section 24 in Township 37 North, Range 8 West, Phelps County, Missouri and more particularly described as:

  2. A condition of the approval of this ordinance is that a recorded deed conveyancing the above-described property to Norman A. & Dora E. That the applicant(s) request(s) that the City Council of the City of Rolla, Missouri, annex into the corporate limits of Rolla, Missouri, the property that is presently unincorporated, yet contiguous to the corporate limits of the City of Rolla, Missouri, and that is identified with the Phelps County Assessor's Account Number 3356.03 and is more particularly described as follows:

And that the Rolla Planning and Zoning Code, which is Chapter 42 of the Code of the City of Rolla, Missouri, and a code that, in accordance with the Comprehensive Plan, divides the City of Rolla into zoning districts; controls the regulation and restriction of the erection, construction, reconstruction, alteration or use of buildings, structures, or land within such districts; and controls the number, shape, and area of  such zoning districts on the Official Zoning Map, is hereby amended by designating the property described in Section 2 of this ordinance and also identified with the Phelps County Assessor's Account Number of 3356.03 as the Heavy Manufacturing District (M-2) on the Official Zoning Map of the City of Rolla.  (Ord. 4457, §3)

Sec. 42-816.     Rezoning of 601 East 10th Street, from R-3 (Multi-Family District) zoning to C-O (Office District) zoning, City of Rolla, Phelps County, Missouri (Allergy & Asthma)

  1. That the Basic Zoning Ordinance No. 3414, Chapter 42 of the Code of the City of Rolla, Missouri which zoning ordinances adopts zoning regulations, use districts, and a zoning map in accordance with comprehensive plan is hereby amended by changing the zoning classification of certain property situated within the City of Rolla, Missouri, at 601 East 10th Street from R-3 (Multi-Family District) zoning to C-O (Office District) zoning.   2. This Ordinance shall be in full force and effect from and after the date of its passage and approval. Building permits may not be issued by the Community Development Department until the revised plat has been filed with the Phelps County Recorder of Deeds. (Ord. 4489, §2)

 


Sec. 42-817.     Rezoning of Lot #2, Municipal Acres No. 2, the parcel identified with the Phelps County Assessor Account Number of 10259.01 at the southwest corner of Lions Club Drive and State Hwy O, from the Neighborhood Business (zoning) District (C-1) to the Two Family (zoning) District (R-2), City of Rolla, Phelps County, Missouri.   1. That the Basic Zoning Ordinance No. 3414, Chapter 42 of the Code of the City of Rolla, Missouri which zoning ordinances adopts zoning regulations, use districts, and a zoning map in accordance with the Comprehensive Plan is hereby amended by changing the zoning classification of the following property situated within the City of Rolla, Missouri, from C-1 (Neighborhood Business) Zoning to R-2 (Two Family) Zoning described as follows:

    A tract of land being all of Lot 4, and part of Lot 5, Hy Point Industrial Park South Plat No. 2 a subdivision filed for record in Plat Cabinet “D” Page 118 being Document Number 2003-10636 in the Recorder of Deeds Office, Phelps County, Missouri and part of the Southwest Quarter of the Southwest Quarter of Section 29, Township 38 North, Range 7 West of the Fifth Principal Meridian and being South of State Highway “V” (width varies) and West of US Highway 66 now known as US Interstate Route 44 (width varies) and being described as follows:

    Beginning at an iron rod at the Southeast corner of Lot 2 of Block 10 of said Townsend Addition; Thence N 88° 51' 09" W on the south line of Lots 1 and 2 of said Block 10 for 124.90 feet to the east line of Business Loop 44 (N. Bishop Avenue), said point being N 88° 51' 10" W 0.66 feet from an iron rod; Thence N 01° 21' 29" E on the east line of said Business Loop 44 for 121.59 feet to a concrete right-of-way marker; Thence N 42° 41' 25" E on said right of way 4.54 feet to the intersection with the south line of West Eleventh Street, same being S 05° 32' 12" W 0.72 feet from a concrete right-of-way marker; Thence S 88° 43' 08" E on the south line of West Eleventh Street 181.25 feet to an iron rod;
    Thence S 01° 14' 25" W on the property line 125.04 feet to an iron rod; thence N 88° 23' 35" W on the property line a distance of 59.60 feet to the POINT OF BEGINNING;
    Containing 0.53 Acres more or less.

    This ordinance is intended to rezone the entirety of the subject property to be in the same zoning district. It is understood that only a portion of the property will be impacted by the ordinance. A description of only the area to be rezoned is not available. (Ord. 4539, §1)
