Sec. 42-714. Rezoning real estate known as 1101 Strobach Street. (Keller)

  1. That the Basic Zoning Ordinance No. 3414, Chapter 42 of the Code of the City of Rolla, Missouri, which said zoning ordinance adopts zoning regulations, use districts and a zoning map in accordance with a comprehensive plan, be and the same is hereby amended by changing the zoning and classification of the following property situated within the City of Rolla, Missouri, and described as follows: 1101 Strobach Street.

    For Zoning change from R-1 (single-family district) to R-3 (multi-family district) zoning. (Ord. 3843, §1)

  2. That the following conditions shall apply:

    1. No more than two residential structures may be erected on this lot.

    2. No more than four residential units may be developed on this lot.

    3. Building height shall not exceed 35 feet as measured from the ground level to the roof peak.

    4. Building separation shall not be less than 10 feet.

    5. As per code, a landscaped buffer yard shall be established between the subject property and any adjoining lots zoned for single-family use. The developer may elect to construct a minimum seven foot site-proof fence to reduce by half the buffer yard area.

    6. No detached signs may be employed. Only street address and apartment numbers may be used as attached signs.

    7. The structures replacing the existing single-family home shall be designed to blend with the appearance of existing neighboring single-family homes in terms of building materials, paint or siding color, and roof type

Sec. 42-715. Rezoning real estate known as 2000 Farrar Drive (Brown)

  1. That the Basic Zoning Ordinance No. 3414, Chapter 42 of the Code of the City of Rolla, Missouri, which said zoning ordinance adopts zoning regulations, use districts and a zoning map in accordance with a comprehensive plan, be and the same is hereby amended by changing the zoning and classification of the following property situated within the City of Rolla, Missouri, and described as follows: 2000 Farrar Drive

    For zoning change from C-3 (highway commercial district) to R-3 (multi-family district) zoning. (Ord. 3856, §1)

  2. That the development of the propety shall be in conformance to the Site Plan (Exhibit A) and the following conditions shall also apply:

    1. Neighborhood character/impact: No negative impact is anticipated for the neighborhood, Adjoining land uses are primarily multi-family housing and storage units. The building coverage is 25% well below the maximum allowed.

    2. Consistency with the 2020 Comprehensive Plan Update: The Future Land Use Map in the 2020 Comprehensive Plan Update depicts this area for medium to high density residential uses. The project shall be constructed in substantial conformance with the site plan submtited with this rezoning application. The developer is proposing to construct 32 units in eight stand-alone structures. The building coverage is 25% of the area in Lot 1 and 2. A 20' landscaped buffer is required between Lots 2 and 3 because City code requires a 20' landscape buffer when R-3 zoning (R-3) and (C-3) zoning abut. The City code also allows the buffer yard to be reduced 50% if property owner wishes to install a 6 foot solid wood or masonry/brick wall. The subject site plan depicts a privacy fence for 100 feet and the remainder as 20 feet of landscaping.

    3. Adequacy of utilities & public services: All services and utilities are available. Utilities will be extended to the development site at the owner's expense.

    4. Impact on streets and parking: There would not be a negative impact on the streets if the property is rezoned due to the width of Farrar Drive. Parking requirements will be addressed in the building permit process when building permits are requested. The attached site plan illusrates the number and location of off-street parking spaces. The site plan is providing 65 parking spaces and the required nubmer is 64 required spaces (two per unit).

    5. Physical characteristics: The property is vacant and slopes to the southeast. A drainage channel is located to the southeast of the subject property. There are no trees or other significant vegetation on the property.

    6. Suitablity for development if rezoned: Because of the location among other multi-family uses, the subject property would be consistent with surrounding neighborhood and is suitable for this type and intensity of development.

One access point may be allowed from Richard Drive (this driveway currently exists.) The applicant will submit a subdivision plat of the subject property before any portion of the property is sold. The plat will show the location of new public streets or private drives.

    3. Calculations to determine the amount of area available for commercial signage and other restrictions shall be limited to what is allowed in C-1 zoned areas.

    4. No new mobile home pads shall be placed in the subject property following the passage of the ordinance approving this rezoning.

    5. The internal streets shall revert to private ownership once the land use is changed from mobile home park to any other use.

That the Basic Zoning Ordinance No. 3414, Chapter 42 of the Code of the City of Rolla, Missouri, which said zoning ordinance adopts zoning regulations, use districts and a zoning map in accordance with a comprehensive plan, be and the same is hereby amended by changing the zoning and classification of the following property situated within the City of Rolla, Missouri, and described as follows: The property located at 809 and 811 Black Street and 103 South Walker Avenue shall be rezoned from R-1 (single-family district) to R-3 (multi-family district) zoning. Sec. 42-769.    Rezoning property at 1301 North Elm Street from C-1 (Neighborhood Business District) zoning to the 13th Street PUD (Planned Unit Development District) zoning (Frueh).

  1. That the Basic Zoning Ordinance No. 3414, Chapter 42 of the Code of the City of Rolla, Missouri, which said zoning ordinance adopts zoning regulations, use districts and a zoning map in accordance with a comprehensive plan, be and the same is hereby amended by changing the zoning and classification of the following property situated within the City of Rolla, Missouri, and described as follows: The property located at 1301 North Elm Street shall be rezoned from C-1 (neighborhood  business district) zoning to 13th Street PUD (planned unit development district) zoning. Sec. 42-770.    Annexing a .91 acre tract adjoining State Route V at 10241 and annex said property into the city pursuant to the provisions of Section 71.012 RSMo and zone the property to R-3 (Multi-Family District) zoning (Lincoln).

  1. Pursuant to the provisions of Section 71.012 RSMO as amended, the boundaries of the City of Rolla, Missouri are hereby altered so as to encompass the following described real estate lying adjacent and contiguous to the present corporate limits and is hereby annexed into the City of Rolla, Missouri described as follows: 

    A fractional part of the NE Quarter of the SE Quarter of Section 30, Township 38 North, Range 7 West, in Phelps County Missouri, beginning at the intersection of the West Right of Way of State Route V and the North line of said Quarter Quarter, said point being on the Current Rolla City Limits;  thence Westerly along said North Line, and said City Limits, approximately 340 feet; thence leaving said City Limits heading Southerly approximately 152 feet; thence Southeasterly approximately 150 feet to the West Right of Way of State Route V; thence Northeasterly along the West Right of Way of State Route V approximately 255 feet back to the said City Limits and the Point of Beginning. Above-described tract containing approximately 0.91 acres. (Ord. 4139)

  2. That the Basic Zoning Ordinance No. 3414, Chapter 42 of the Code of the City of Rolla, Missouri, which said zoning ordinance adopts zoning regulations, use districts and a zoning map in accordance with a comprehensive plan, are hereby amended by changing the zoning classification of the subject property as described in Exhibit “A" from No Zone to R-3 (multi-family district) zoning.

  3. This ordinance shall be in full force and effect from and after the date of its passage and approval by City Council. 


Sec. 42-771.    Rezoning Lot 4 McCutchen Acres No. 2, formerly a part of Tract B, McCutchen Acres No. 1, from R-1 (Single Family District) zoning to R-2 (Two Family District) zoning. (Davis).

  1. That the Basic Zoning Ordinance No. 3414, Chapter 42 of the Code of the City of Rolla, Missouri, which said zoning ordinance adopts zoning regulations, use districts and a zoning map in accordance with a comprehensive plan, be and the same is hereby amended by changing the zoning and classification of the following property situated within the City of Rolla, Missouri, and described as follows: The property located at Lot 4 McCutchen Acres  No. 2, shall be rezoned from R-1 (single family district) zoning to R-2 (two family district) zoning.   2. That the requirement to fully extend 18th Street as outlined in Ordinance 3939 is hereby waived. (Ord. 4143, §2)

  3. That upon further re-subdivision of McCutchen Acres No. 1 or the development of Lots 1 or 2 of McCutchen Acres No. 2, 18th Street shall be fully extended from McCutchen Drive to Forum Drive meeting all City standards for a commercial collector. (Ord. 4143, §3)

  4. That curb and sidewalk requirements for McCutchen Drive adjacent to Lots 3 and 4 of McCutchen Acres No. 2 shall be met with the development of Lot 4 of McCutchen Acres No. 2. (Ord. 4143, §4)

  5. That parkland dedication fees required from residential subdivisions shall be satisfied by accepting fee-in-lieu-of payment for all of McCutchen Acres No. 2. (Ord. 4143, §5)

  6. That on-site storm water for Lots 3 and 4 of McCutchen Acres No. 2 shall be provided with the development of Lot 4. (Ord. 4143, §6)

  7. The developer agrees to provide a fifteen-foot wide buffer yard along the southern border of Lot 4.  The buffer yard may be reduced by half if a sight-proof fence of no more than seven feet tall is constructed along the aforementioned lot border. (Ord. 4143, §7)

That the attached Development Plan, which calls for 30/4 plex buildings consisting of 120 dwelling units, shall govern the development of this property as described in Sec. 42-177.5 Site Plan Required.  The Development Plan may be amended by the City Council with recommendations from the Planning and Zoning Commission. That the Basic Zoning Ordinance No. 3414, Chapter 42 of the Code of the City of Rolla, Missouri, which said zoning ordinance adopts zoning regulations, use districts and a zoning map in accordance with a comprehensive plan, be and the same is hereby amended by changing the zoning and classification of the following property situated within the City of Rolla, Missouri, and described as follows: 621 Houston Road shall be rezoned from R-1 (Single Family District) zoning to R-3 (Multiple Family District) zoning.   2. The owner agrees to limit development to one 4-plex structure.  Each unit of the 4-plex shall be limited to no more than three bedrooms and shall provide no less than 2.5 parking spaces per unit.  Further, the owner shall provide a fifteen-foot wide buffer yard along the border between 619 Houston Road and 621 Houston Road, as required under Sec.42-177.3 of the Rolla Planning and Zoning Code.  The buffer yard requirement may be reduced by half if a sight-proof fence of no less than six feet tall is constructed along the aforementioned lot border. That the Basic Zoning Ordinance No. 3414, Chapter 42 of the Code of the City of Rolla, Missouri, which said zoning ordinance adopts zoning regulations, use districts, and a zoning map in accordance with the Comprehensive Plan, is hereby amended by changing the zoning classification of the following property situated within the City of Rolla, Missouri, and described as follows:

    Lots 1 through 8 and Lot 10 of the Kayser North Subdivision No. 2

That the attached 4.77 acre original site plan, which called for 30, four plex units consisting of 120 residential units, adopted by the Rolla City Council on August 4, 2014, under Sec. 42-234.1(b) of the Rolla Planning and Zoning Code, is hereby eliminated.  The Rolla Investors, LLC have prepared a replacement site plan consisting of 5.64 acres with 160 dwelling units and 376 beds to be adopted. That the developer(s) will install a sanitary sewer system along the southern boundaries of Tracts 1 and 3 and that a minimum 10' wide easement suitable to support the construction of a water main sufficient to serve Tracts 1 and 3, as determined by Rolla Municipal Utilities (RMU), including any dedicated utility easements. Water service for Tract 1, when annexed into the City, will be tapped in to the new water main at a location determined by RMU; (Ord. 4286, §6)

  7. That Rolla City Code requires the establishment of a buffer yard to screen property zoned R-1 (Single Family District) Zoning and C-2 (General Retail District) zoning when C-3 (Highway Commercial District) zoning is proposed.  In this case, the City has already received dedicated open space, including space in the 100-year flood plain, associated with the approval of the University Park Subdivision in 2002. This dedication satisfies the buffer yard requirement.
