The cemetery of the city, and the Weber Cemetery are recognized as legal and proper places of interment of persons who may die in the city, or who may be brought to the city for burial. (Ord. 923, §1.)
(a) Curfew: No person shall be within or loiter upon the grounds of the Rolla Cemetery from one hour after sunset to one hour before sunrise.
(b) Penalties: Violation of this Ordinance shall be punished in accordance
with the provisions of Section 1-7 of the General Ordinances of the Code of
the City of Rolla, Missouri. (Ord. 2217, §§1, 2.)
It shall be unlawful to bury deceased persons in the city, except in a cemetery or burying ground which has been recognized by the city council as legal and proper places of interment. (Ord. 923, §2.)
No cemetery or burial ground shall be laid out, established or the limits of an unauthorized cemetery or burial ground extended without a permit for same to be issued by and at the direction of the city council. (Ord. 923, §4.)
Every person owning any cemetery or burial ground not private, or having in his charge or control, or exercising supervision over such cemetery or burial ground, in which bodies are allowed to be buried, shall file in the office of the city clerk a plat of such cemetery or burial ground, showing its walks, ways, roads and the number and sizes of the burial lots therein, the names of their respective owners, so far as such cemetery has been laid out and sold. Annually, on or about the first day of January, such person shall file, so as to continue from year to year the original plat until it shall show the whole tract subdivided into lots and the owners' names, a corrected plat showing new thoroughfares and places, if any have been laid out, and all lots, with the names of the owners and size indicated on each lot, sold since the previous January first. No body of any deceased person shall be buried in any cemetery within the city at less depth than that permitted by the state board of health. Burial vaults or tombs shall be erected for the reception of deceased persons. (Ord. 923, §12; Ord. 4025, §1)
No person shall willfully destroy, disfigure or injure any wall, fence, ledge, monument, tombstone, tree or shrubbery around or within any cemetery, graveyard or burial ground nor shall any person use such a cemetery, graveyard or burial ground for any purpose other than a burying ground. (Ord. 923, §14.)
No person, except as provided in Section 7-27, shall dig or open a grave in the cemetery of the city. Such work shall be done by the city upon the payment of the fees required in Section 7-26. (Ord. 923, §10.)

Sections 2-92 through 2-98*, inclusive, of the Code of the City of Rolla, Missouri, are hereby repealed, thus dissolving and abolishing the Rolla Cemetery Association Board. (Ord. 2233, §1.)

The powers and duties heretofore borne by the cemetery board shall hereafter
be performed by the parks and recreation department of the City of Rolla, Missouri.

The funds now in existence in the Rolla Cemetery Association Board's perpetual
care account, together with all sums hereafter acquired as cemetery eternal
care maintenance fees, shall be deposited in an interest-bearing account, with
such interest income to be used solely for the continual upkeep, care, maintenance,
and beautification of the Rolla Cemetery. The principal of said funds shall
be kept intact, shall not be subject to transfer or diversion to any other account,
and at no time shall any portion of principal of the eternal care fund be used
for any purpose other than investment. (Ord. 2233, §3.)
It shall be unlawful for any person to carry the body of any deceased person
to any of the cemeteries or burying grounds within the city, or for the parks
and recreation director, or other person in charge of such cemetery or burying
ground to receive the body of any deceased person, unless accompanied by a burial
permit, properly signed and certified by the city clerk or his deputy. (Ord.

Before the burial permit shall be issued, the applicant therefore shall pay the following fees:
(a) If the person to be buried is under the age of six years, the fee shall be: | |
(1) Weekday | $240.00 |
(2) Weekend | $480.00 |
(3) Holiday/Holiday Weekend | $720.00 |
(b) If the person to be buried is of the age of six years and over, the fee shall be: | |
(1) Weekday | $600.00 |
(2) Weekend | $990.00 |
(3) Holiday/Holiday Weekend | $1,400.00 |
(c) If the person to be buried has been cremated, the fee shall be: | |
(1) Weekday | $230.00 |
(2) Weekend | $440.00 |
(3) Holiday/Holiday Weekend | $660.00 |
(d) If the person to be buried is going to be placed in a crypt, mausoleum the fee shall be: | |
(1) Weekday | $230.00 |
(2) Weekend | $440.00 |
(3) Holiday/Holiday Weekend | $660.00 |

No burial permit shall be issued for the burial of any deceased person in any cemetery or burial grounds within the city, unless the person owning such cemetery or burial grounds, or exercising or having charge and control of such cemetery or burial grounds, shall have complied with all the provisions of this Chapter. (Ord. 923, §13.)
Upon application and the payment of a fee required by Section 7-26 to the city clerk, for the use and benefit of the city, it shall be the duty of the city clerk to issue to the applicant a burial permit which shall be given a number, and which shall specify what cemetery or burial ground, the section, lot and grave number, the deceased person is to be buried in, giving the applicant one copy of such permit to be delivered to the director of the parks and recreation department and keeping one copy for the records of the city. After issuing such permit, it shall be the duty of the city clerk to place in the proper place, upon the plat in his office the number of the permit and the name of the deceased person.
