Procedure for Rezoning Property in the City of Rolla

Applications
Rezoning applications are available at the Community Development Department within Rolla’s City Hall, which is located at 901 North Elm Street, PO Box 979, Rolla, Missouri 65402 (telephone 573-364-5333/fax 573-426-6978). People with financial, contractual, or proprietary interest in real property located in the Rolla, Missouri, may propose a rezoning of a parcel by submitting a rezoning application to Rolla’s Community Development Department. The fee for the review of a rezoning application is $200. In addition, there is a newspaper advertising fee of $62.50. This advertising fee pays for the cost of publishing a “Notice of Public Hearing” advertisement in the Rolla Daily News’ newspaper. The application must be accompanied by a payment of $262.50, which, if paid by check, should be payable to the city of Rolla. The Planning and Zoning Commission will consider rezoning proposals on the second Tuesday of the month. The proposal will then be put on the agenda for the next two City Council meetings.

Public Notice
The Community Development Department advertises the public hearing at least 15 days before the public hearing that is held at the City Council meeting. In addition, the Community Development Department will notify the property owners within 185 feet of the boundaries of the portion of the zoning district that is proposed to be changed. These property owners may sign a “protest petition” opposing a rezoning request. If 30 percent of the property owners (excluding streets and alleys) sign the protest petition, a two-thirds majority of the City Council is required to approve the request. Otherwise, a simple majority of 51 percent is required to approve a rezoning request. Any such protest petitions must be signed and notarized, and should be turned into the Community Development Department at Rolla’s City Hall.

Planning & Zoning Commission and City Council Meetings
All Planning & Zoning Commission and City Council meetings take place in the City Council Chambers at Rolla’s City Hall, which is located at 901 North Elm Street. The Planning and Zoning Commission meets at City Hall on the second Tuesday of each month at 5:30 P.M. At the Planning and Zoning Commission meeting, the Chairperson will open the public hearing and request comments from the owners of properties within 185 feet of the rezoning area. The Chairperson will then ask for comments from other members of the public. After the Public hearing is closed, the Planning and Zoning Commission votes to recommend approval or denial.

The City Council meets on the first and third Monday of each month at 6:30 P.M. at Rolla’s City Hall. The City Council has the final authority to approve or deny the request. On the third Monday, the City Council holds a public hearing, which is held in the same manner as the Planning and Zoning Commission’s public hearing, and the first reading of the ordinance that is created to enact the rezoning is heard. On the first Monday, the final reading of the rezoning ordinance is heard and the City Council votes to approve or deny the ordinance.
